Business Ethics and User Agreement

 

Purpose of the Agreement: NPS is in the business of providing Kennel Owners and Breeders a market where their puppies and dogs may be offered through an exclusive membership only internet posting service. NPS desires to only associate itself with responsible breeders who operate their kennels consistent with the highest concern for the quality of life for the animals under their care and for the quality of the breeds in which they produce. Breeders are welcome to make application for membership as long as they are in agreement with the terms and conditions of this Agreement. 

Whereas Member, desires to be accepted as a NPS Member,  and attests they desire to associate themselves with NPS as a member in good standing and agree to the terms and conditions as follows herein.   

NPS and Member Agree as follows herein:

Part I:   Business Conduct and Membership:  If accepted by National Pet Services,  Member agrees to the covenants listed herein concerning any and all transactions in which Member may participate.

A.  Truth In Advertising: 

(1.)  Information posted in Members advertisement will be truthful and accurate to the best of Members knowledge. 
(2.)  Member will not willingly mislead nor misrepresent the condition or with hold any pertinent facts concerning the  breeding, health and or conditions of the puppies, dogs or litters as advertised.
(3.)  Upon request Member will give full discloser of pedigree, health records, Shot records and any temperament or genetic information to the best of Members knowledge.
B.  Health Guarantee: 
(1.)  Member agrees to provide and honor a health guarantee to any buyer of any puppy, dog or litter.
(2.)  And should the animal found to be unfit on delivery or during the term of the guarantee Member will remedy the defective problem consistent with the Breeders guarantee 
C.  Registration Papers:
(1.)  Member agrees to provide all Registration papers as promised.
(2.)  In the event administrative errors occur with a registry, Member agrees to assist with all means available to correct the error (if made by Member) and to assist the new owners in anyway as may be required by the Registry.
D.  Reporting Transactions:  The best marketing tool is one that is maintained with current and accurate information. To insure current and accurate information, NPS requires of its members to report completions of all transactions. 
(1.)  Member agrees to report promptly the completion of all transactions. Using the Member transaction report in the member section.  See Report Example
E.   Membership Status: 
(1.)  Member agrees and understands NPS reserves the right to approve, disapprove or revoke  membership status at anytime.
(2.)  In the event of revocation of membership, Member understands and agrees to hold NPS harmless concerning it's (NPS) decision to revoke. 

Part II:   Animal Care and Business Operations:

A.  Member agrees to operate consistent with all Local, State and Federal guidelines concerning the health, maintenance, and care of all animals owned or in trusted to Member .  Member further agrees to abide by all Local, State and Federal laws pertaining to the transportation of animals as it may apply to Members transactions.

Part III: Membership and Dues:
A.   Re-Occurring Charge Card Permissions:
(1.)  All NPS Memberships are based on one (1) year renewal memberships. Member may elect to pay for Membership dues in payments or in one annual payment.
(2)  Memberships are automatically renewed, unless member indicates his/her desire to terminate prior to the anniversary date of the Members acceptance date.
(3.)  Member, authorizes NPS to process credit card transaction consistent with the payment options as selected.
B.   Membership: .
Membership is granted on a once per life time acceptance. Should membership be revoked due to violations of the Business Ethics and User Agreement or is found guilty of cruelty to animals or in the case where any State or Federal license is revoked. Membership will be revoked for life.  Member may appeal revocations, any and all decisions concerning appeal are final.

C.   UserID and Password Control:  

 Each member is entitled to (1) one UserID and Password for his or her respective business, multiple user accounts are available. Allowing access to any non members is prohibited, violation of UserID and Password Control will terminate Members right to conduct business with NPS.

Part IV: Fitness Statement:

A.   Member attests that if accepted by NPS Member will honor the covenants of this Agreement to the best of Members abilities. Member further attests, that Member is in good standing with all Local, State and Federal Agencies concerning the health and care of animals and have never been convicted of any animal welfare laws in any state in which Member has conducted business.
